本隱私政策適用於The Nutter Company Limited（以下稱「本公司」或「我們」）會員計劃的所有用戶，其個人資料可能由本公司作為資料使用者或處理者進行處理。

本隱私聲明闡述我們如何收集、使用及管理您提供給我們的個人資料，或我們不時就您所加入的計劃相關服務所收集、生成及/或整理的個人資料（統稱「資料」）。

資料收集的目的

(a) 處理您的會員申請，管理您的會員資格以及本公司會員計劃的獎勵發放與兌換；
(b) 存取及檢索您的帳戶信息，並管理與本公司提供的產品或服務相關的帳戶；

(d) 分析及維護客戶或用戶檔案、行為及使用模式，並生成及編製聚合、匿名、統計及/或衍生資料；

(f) 開發及改進產品、服務、業務系統、運營及基礎設施以及業務規劃；

(h) 與上述任何目的直接相關的目的。

上述(a)至(h)段所述的產品及服務，以及與本公司會員計劃的功能或活動直接相關的任何產品及服務，以下統稱為「服務」。

您的資料

我們可能收集或編製關於您的資料，包括但不限於：

(a) 聯繫資料，包括姓名、地址、電話號碼、移動電話號碼及/或電子郵件地址；
(b) 您如何使用服務的相關信息，包括您的使用情況；
(c) 為服務或任何直接相關目的而便於身份驗證的信息；
(d) 您的服務歷史及相關信息；
(e) 適用政府機關、法院、執法機構或其他機構或監管機構要求的所有資料，以使我們能夠遵守或與香港境內或境外的任何法律、規則、規例、指引、判決或法院命令相關；
(f) 為本公司會員計劃的註冊、申請、訂閱、提供、使用、管理及/或運營所需的任何其他資料。

資料收集

我們通過以下方式收集資料：

(a) 直接從您收集，例如當您通過WhatsApp或電子郵件提供資料、參與我們的活動或功能、填寫會員計劃的申請表或協議、通過我們的網站、客戶服務熱線或在線聊天提交資料，或當您聯繫我們進行查詢或請求，或當我們依法需要這樣做時；
(b) 公開可用的來源；
(c) 我們關於您如何使用服務的記錄；
(d) 您參與我們組織的調查或營銷推廣活動。

直接促銷

在您同意的情況下，本公司可能使用您的資料（包括您的姓名、聯繫信息、產品及服務組合信息、使用情況、交易模式及行為、人口統計資料及相關衍生資料）向您發送直接促銷通訊。直接促銷通訊可能以多種方式進行（例如電子郵件、數碼短訊、多媒體訊息、WhatsApp訊息、電話、針對性及/或個人化的社交媒體或網站廣告或其他方式）。

分享個人資料

The Privacy Policy applies to all users of The Nutter Company’s membership program, whose data may be handled, whether as data user or processor, by The Nutter Company Limited (“the Company”, “we”, “us” or “our”).

This Privacy Statement sets out how we collect, use, manage and protect any personal data that you provide to us or which we collect, generate and/or compile about you from time to time in connection with the services to which you subscribe (collectively “Data”).

Purpose of Data Collection

We may collect, use and disclose a range of different Data about you for the following purposes:

(a)   processing your application for membership, and administering your membership and reward issuance and redemption, of the Company’s membership program;

(b)   accessing and retrieving your account information and managing your account in relation to products or services provided by the Company;

(c)   with your consent, for direct marketing purposes;

(d)   analysing and maintaining customer or user profile, behaviour and usage patterns, and generating and compiling aggregated, anonymous, statistical and/or derived data;

(e)   complying with applicable laws, rules, regulations, guidelines and license requirements or obligations in or outside Hong Kong as may be required by government authorities, courts, law enforcement, or regulatory or investigation bodies or industry best practices;

(f)   developing and improving products, services, business systems, operations and infrastructure and business planning;

(g)   any other purposes to which you consent from time to time; and

(h)   purposes which are directly related to any of the above purposes.

The products and services referred to in paragraphs (a) to (h) above and any those directly related to a function or activity of the Company’s membership program, above are collectively referred to as “Service(s)” hereafter.

Your Data

We may collect or compile Data about you such as, but not limited to:

(a)   contact details including name, address, phone number, mobile telephone number and/or email address;

(b)  information about how you use the Services , including your usage;

(c)  information that facilitates identity verification for the purposes of the Services or any directly related purposes;

(d)  your service history and information;

(e)  all Data requested by applicable government authorities, courts, law enforcement or other authorities or regulatory bodies to enable us to comply with or in connection with any law, rule, regulation, guideline, judgment or court order (whether within or outside of Hong Kong); and

(f)  any other Data as may be necessary for the registration, application, subscription, provision, use, administration and/or operation of the Company’s membership program.

Data Collection

We collect Data in a number of ways, including from:

(a)     you directly, for example, when you provide Data by WhatsApp or via email, participate in our functions or activities, complete an application form or agreement for our membership program, or when you submit your Data through our websites, over any customer service hotlines or online chat sessions; or when you contact us for any query or request; or when we are legally required to do so;

(b)     publicly available sources;

(c)     our own records of how you use the Services;

(d)     your participation in surveys or marketing promotions organised by us. 

Direct Marketing

With your consent, the Company may use your Information (including your name, contact information, products and services portfolio information, usage, transaction pattern and behaviour and demographic data and related derived data) to send you direct marketing communication. Direct marketing communications may be carried out in a variety of ways (such as in the form of an email, digital SMS, MMS, WhatsApp message, by telephone, targeted and/or personalised social media or advertisements on websites or other means).

Sharing Personal Data

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example, we may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

You may resume receiving the marketing materials and/or communications (if you have previously opted-out of receiving such material) by making a written request to our Marketing Manager together with your registered name, registered telephone number or e-mail address or social media account (as applicable).

Your Right to Access and Correct Data

We take all reasonable precautions to ensure that the Data we collect, use and disclose is accurate, complete and up-to-date. However, the accuracy of that Data depends to a large extent on the Information you provide. You have a right to request access to, and correction of, your Information and we recommend that you:

(a)     let us know if there are any errors in your Data; and

(b)     keep us up-to-date with changes to your Data.
